digitus tertius



I regret being caught up in the "spring rush" around here. It is not a dereliction of duty it is overwhelming duty that has cut my free time for blogging a bit. From previous posts you know my devotion to the Constitution and laws of our nation along with those who serve our nation. HOWEVER, When it comes to the , digitus tertius police might need a thicker skin.



In a 3-0 decision Wednesday, the court said Taylor Officer Matthew Minard "should have known better," even if the driver was rude. A federal appeals court says a Michigan woman's constitutional rights were violated when she was handed a speeding ticket after giving the finger to a suburban Detroit officer in 2017. The decision means a lawsuit by Debra Cruise-Gulyas can proceed.



Minard stopped Cruise-Gulyas and wrote her a ticket for a lesser violation. But when that stop was over, Cruise-Gulyas raised her middle finger.



Minard pulled her over again and changed the ticket to a more serious speeding offense.



Cruise-Gulyas sued, saying her free-speech rights and her rights against unreasonable seizure were violated.



Like it or NOT... the system works... sluggish at times but it works.

If you've driven the Autobahn there's no good reason why our Interstates could not be 90 MPH or even 100 MPH

All sizes of vehicles occupy the highways, and about half the traffic is large trucks that are incapable of safely going 95 or 100 mph. Truck drivers seem comfortable at a maximum speed of 65 or 70 mph.. If you have a higher posted speed limit, the light vehicles will be darting around the large vehicles causing a traffic hazard. For a smooth and safe flow of traffic, the posted speed must be what the vast majority of vehicles are capable of.

Our state was 75 on interstates and 70 on secondary before the oil embargo. In vehicles that didn't have safety glass, seat belts or air bags. We have great distances to cover between cities which wastes out time. Our roads are better kept than most other states especially Democratically controlled states.

I happen to have small light weight vehicles most of the time and love darting around and through traffic. If the vehicles can't or are unwilling to go at faster speeds relegate them to secondary roads where they may putter along from soccer field to soccer field. Interstates are for rapid transit our semis can handle 80 mph with no difficulty what so ever. Keep traffic moving with vehicles and drivers that can handle the pace.

I'm not saying that all cops are good cops but the majority are good well meaning cops and I know that for a fact and they do not need to be disrespected by being flipped off by someone that thinks that laws don't apply to them.

Unless you have been a cop or walked in their shoes you do not know what they have to put up with and endure. You don't know what they had to put up with from the person they dealt with right before you. Many cops only do their job as they are required to do and if someone gets pulled over it is usually for a reason such as; speeding, safety violation, etc.

Most cops if asked why they became a cop will answer, "Because I want to help people" and many of them are cops in the community that they grew up in. Cops do much more than write tickets and try catch law breakers.

One driver does not decide what the safe speed limits are for the rest of us. Many people still text and use cell phones while driving. The sad part about that is everyone that has killed someone in an accident because of distracted driving has said that they can text and drive at the same time. Well obviously they can't, can they. Then there are impaired drivers that get in an accident and take off, hit and run, because they did not want to get caught. Some cases the victim has died from the driver not reporting the accident.

Recently someone just trying to cross the street on a green light was run over by a woman texting. and not paying attention and the sad part is that she just slowed a bit and then sped off. The victim laid on cold frozen street at about 3:30 am and died. Paramedics and doctors said that if that would have been reported right away then that victim could have been saved. What caught the driver was the camera mounted on the horizontal pole by the traffic lights got the license plate. That woman is now serving prison time for manslaughter but she would not have been caught if it was not for that camera, which caught the whole incident.

Years back when I was in a male mode I worked for a sheriff's office for about a year and a half and was always respectful and used the terms sir, mam and miss but sometimes I was met with disrespect and treated very rudely in return by someone that thought the law was not meant for them. Before I resigned and went on to something else cuz I could feel my fem side coming back on, I asked myself why any decent law abiding person would want to be a cop?

I do know that most cops are decent people and if you are respectful to them they will be respectful to you. If someone thinks that we don't need cops, just think about what it would be like to be without them, even for a few days it would be utter chaos for decent people. Not everyone is a decent person! If it was not for cops enforcing the laws, then gay people could very well be an endangered species.

So I think I saw a video on TV of this a short while back. I remember a very disrespectful woman being rude to the officer and met him with a barrage of insults, name calling and cussing when he approached the car. She flipped him as she peeled out and was once again speeding. She continued to break the law and show contempt for the officer and the law just because she was having a bad day. The officer was trying and continued to be polite and respectful to her.

So what was the officer supposed to do? Let her continue to break the law? In the video he went back after her again for excessive speed and unsafe driving. I wonder if that was the same case? From what I saw was the officer was doing his job.

We are in most places as flat as West Texas, Why the hell hold us back and waste our time. I agree with your assumption for her protection and that it showed poor judgement on her part, as well as, a complete lack of respect for authority. She should have kept her emotions to herself but I do admire her bravado for not cowering and putting her money where her mouth was and fighting to preserve her Constitutional rights.

I have gracefully surrendered maintaining my respect for the officer when caught for speeding. The incident of texting and driving distracted is a nationwide problem which needs to be better addressed with more enforcement. It takes a special person to be a cop as I am an unqualified fascist who would abuse the powers handed to them promoting my personasl agenda upon the community. With that said the cop in question might just be one of those who oversteps the blue line inthat he went after the woman instead of just shrugging her off. If she was speeding again then she deserves a second harsher ticket.

The 4th picture down is the cop involved with the incident having not seen the video nor being able to confirm the identity of Debra Cruise-Gulyas I have to recuse myself of any judgments from the video or it's contents.

Having Officers of the Law in my family, I can't comment without bias. Everyone and anyone ARE NOT ABOVE the law !! Now as for speed limits, my foot can't read the majority of the time !! My insurance rates are proof of that !! Being 25 doesn't help either !!

I understand where you are coming from, however, there could be a repercussion from the OP powers that be if we advocate violence.
